Membership Agreement

This English version is provided for information. The Turkish version is the binding text and prevails in case of any discrepancy, without prejudice to any mandatory consumer rights you have under the law of your country of residence.

1. Parties

This agreement is concluded electronically, when the account is created, between Zeynep Metin – The Babiest, Aydınlar Mah. Hürriyet Cad. No: 186/B Çankaya/Ankara, Türkiye (Başkent Tax Office, Tax ID 16053017520; info@thebabiest.com; KEP: zeynep.metin.2@hs01.kep.tr) (“The Babiest”) and the person creating an account on www.thebabiest.com (the “Member”).

2. Subject

This agreement sets out the conditions for using the membership services on the Site and the rights and obligations of the parties. Each order placed on the Site is also subject to the Distance Sales Agreement. General rules for using the Site are in the Terms of Use.

3. Membership

1. You must be 18 or over and have legal capacity to become a Member.
2. Membership is completed by filling in the sign-up form, accepting this agreement and confirming the verification link sent to your email address. If an account is created at checkout, membership is opened directly with the email address used for the order.
3. The Member confirms that the details given at sign-up and checkout are accurate, current and their own, and updates any changes under “My Account > Settings”.
4. Verifying a phone number is optional and is done with a one-time code sent by SMS.
5. Membership is free and personal; it cannot be transferred.

4. Membership Services

Members can track orders and shipments, keep an address book, create a favourites list, submit return requests, write product reviews and receive back-in-stock alerts. The Babiest may develop, change or discontinue parts of these services; rights relating to orders already placed are not affected.

5. Account Security

1. The Member must keep their password confidential and take reasonable care to prevent unauthorised use of the account. Passwords are stored by The Babiest in irreversible form and cannot be seen by any staff member; we will never ask for your password by email, phone or message.
2. If “Remember me” is ticked, the session stays open on that device for up to 30 days. We recommend not using this option on shared devices.
3. If the Member suspects unauthorised use, they should change their password and notify info@thebabiest.com immediately.

6. Member’s Obligations

• to use the Site in accordance with applicable law, this agreement and good faith,
• not to open an account in someone else’s name or with false details, and not to use someone else’s account,
• not to disrupt the Site, endanger its security, or collect data automatically (bots, scraping),
• not to post reviews that are untrue, misleading, insulting, infringe personal or intellectual property rights, or contain advertising or personal data (phone numbers, addresses etc.).

7. Product Reviews

Reviews are checked before publication. The Babiest may decline to publish or remove reviews that breach clause 6; a review being positive or negative is not in itself a reason not to publish it. Reviews of purchased products may be marked “verified buyer”. The Member agrees that the review is published with the visible part of their name and may ask for its removal at any time.

8. Promotional Messages

Offers and newsletters are sent only if the Member gives separate consent at sign-up or later; this consent is not a condition of membership. Details and how to opt out: Consent to Commercial Electronic Messages. Messages about orders, shipping, password resets and account security are not commercial messages and are sent regardless of consent.

9. Personal Data

Personal data processed for membership is processed to conclude and perform this agreement, as described in our Privacy Notice (KVKK) and Privacy Policy. Accepting this agreement does not mean giving explicit consent to data processing.

10. Ending Membership

1. The Member may end their membership at any time by writing to info@thebabiest.com from their registered email address. When the account is closed, membership data is deleted or anonymised, except order and invoice records that must be kept by law.
2. If the Member breaches this agreement or the law, uses false details or harms the Site, The Babiest may suspend or close the account, notifying the Member with reasons. This does not affect the Member’s rights arising from orders already placed.

11. Changes to this Agreement

The Babiest may update this agreement to reflect changes in the law or its services. Material changes are announced on the Site and/or by email before they take effect. A Member who does not accept a change may end their membership. Changes do not affect orders already placed to the Member’s detriment.

12. Evidence and Disputes

Correspondence between the parties and the Site’s electronic records may be used as evidence in disputes; the Member’s right to submit evidence to the contrary is reserved. This agreement is governed by the laws of the Republic of Türkiye. Disputes may be brought before consumer arbitration committees within the monetary limits, and above those limits before the consumer courts after mediation; consumers’ statutory choice of forum, including the authorities where the Member lives, is reserved. For consumers resident outside Türkiye, the mandatory consumer-protection rules of their country of residence are not affected.

13. Entry into Force

This agreement takes effect when the Member creates an account by accepting it on the sign-up form or at checkout, and remains in force until membership ends. The current text is always available on this page.
