Explicit Consent Statement

This statement explains which processing activities we, Zeynep Metin (The Babiest), ask your explicit consent for. For everything else, and for our contact details, please see our Privacy Notice (KVKK).
1. Processing for Which We Do Not Ask for Consent, and Why
Under the KVKK, explicit consent is only sought where no other legal ground applies, and it cannot be made a condition of a service. We therefore do not ask for consent for the following, which rely on other grounds in KVKK Article 5(2):
- creating and managing your account, taking your order, embroidering your personalised item, shipping, returns and exchanges (contract, Art. 5(2)(c)),
- invoicing and record keeping under consumer and tax law (Art. 5(2)(a) and (ç)),
- sharing the details needed for delivery to an address abroad with carriers and customs (transfer necessary for performance of the contract, Art. 9(6)(b)),
- strictly necessary cookies and security logs (Art. 5(2)(c) and (f)).
The “I have read and accept the Membership Agreement” box on the sign-up form is not a consent to data processing; it is acceptance of the agreement and confirmation that you have read the privacy notice.
2. Processing Based on Your Explicit Consent
The following processing takes place only if you give explicit consent. A separate box or choice is offered for each, never pre-ticked. Refusing has no effect on shopping, signing up or any other service.
2.1. Offers, newsletters and promotional messages
If you opt in on the sign-up form or the newsletter box, your name, email, phone number and the date and channel of your consent are processed to send you offers, discounts, new products and special-occasion news, and to record your consent in the Turkish Message Management System (İYS). Consent under Law No. 6563 is also collected through our Consent to Commercial Electronic Messages. If the servers of the email or SMS provider are located abroad, we sign the standard contract published by the Board with that provider.
2.2. Analytics and marketing cookies
If analytics (e.g. Google Analytics) or marketing/ad measurement tools (e.g. Meta Pixel) are enabled on the Site, their cookies run only if you actively accept them in your cookie choices. Your online identifiers and on-site browsing data are then processed to produce visit statistics and measure ad performance, and may be transferred to the servers of these tools abroad. Where there is no adequacy decision or appropriate safeguard, this transfer relies on your explicit consent given after being informed of the risks (KVKK Art. 9(6)(a)): your data may be processed in a country for which the Board has not found a level of protection equivalent to that in Türkiye. 3. How to Withdraw Consent
- use the unsubscribe link or instruction in any email or SMS we send,
- through İYS (iys.org.tr, e-Devlet or the İYS mobile app),
- by writing to info@thebabiest.com or to our KEP address zeynep.metin.2@hs01.kep.tr,
- for cookies, through the cookie choices on the Site or your browser settings.
Withdrawal does not affect the lawfulness of processing before it. Opt-outs are applied within 3 business days at the latest.
4. Consent Statement
By ticking the relevant box or choosing “Accept” in the cookie choices, you confirm that you have read this statement and the Privacy Notice, and that you freely give explicit consent to the processing, and where necessary the transfer, of your personal data for the purposes described above, only for the items you selected.
